These Terms of Service (the "Terms") govern your access to and use of the TFD Insurance website at tfdinsurance.com and all related products, content, and services (collectively, the "Services"), provided by TFD Insurance ("TFD Insurance," "we," "our," or "us"). By accessing the Services, submitting a quote request, or otherwise interacting with TFD Insurance, you acknowledge that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy. If you do not agree, you must stop using the Services immediately.
We may revise these Terms at any time as described in Section 12. Your continued use of the Services after a revision becomes effective constitutes your acceptance of the revised Terms.
TFD Insurance operates an online auto insurance comparison and lead-generation platform. We help consumers gather quote information and connect with third-party insurance carriers, brokers, and licensed agents who may offer auto insurance products. TFD Insurance is not an insurance carrier, agency, or broker. We do not underwrite, issue, sell, bind, or otherwise transact insurance policies. Decisions about coverage availability, pricing, eligibility, underwriting, and claims handling are made solely by the third-party carriers and agents you choose to engage. TFD Insurance is not a party to any insurance contract you enter into and has no responsibility for the performance of any policy.
To use the Services you must be at least 18 years old, a resident of the United States, legally able to enter into binding contracts, and the rightful subscriber of any phone number, email address, or other contact information you provide. You agree to provide accurate, current, and complete information when requesting a quote and to update that information as needed. Providing false, misleading, or fraudulent information may result in inaccurate quotes, denial of coverage by carriers, and termination of your access to the Services.
When using the Services, you agree not to:
By submitting your phone number through any TFD Insurance form (including the home-page quote form), by checking the consent checkbox accompanying that form, or by giving verbal consent to a TFD Insurance representative, you expressly consent to receive recurring autodialed and prerecorded telephone calls and text messages from TFD Insurance and from the insurance carriers, brokers, and licensed agents in our partner network at the wireless or landline number(s) you provide, even if those numbers are listed on a federal, state, internal, or wireless Do Not Call list.
Types of messages. The messages you may receive include, without limitation, quote confirmations, follow-up reminders to complete an unfinished quote request, notifications matching you with carriers, scheduled call reminders, customer-service responses, satisfaction surveys, marketing offers about insurance products, savings opportunities, and policy-renewal reminders.
Frequency. Message frequency varies and depends on your interaction with the Services and on the carriers you choose to engage. You may receive recurring messages.
Charges. Message and data rates may apply, depending on your wireless plan. TFD Insurance does not charge a separate fee for sending or receiving messages, but your wireless carrier's standard rates apply.
Carrier liability. Mobile carriers (including AT&T, Verizon, T-Mobile, and others) are not liable for delayed or undelivered messages.
How to opt out. You can opt out of TFD Insurance text messages at any time by replying STOP to any text message you receive from us. After we receive your STOP request you will receive a one-time confirmation message and no further marketing text messages will be sent unless you re-enroll. To opt out of messages from a specific carrier or partner, you may need to reply STOP separately to those messages, as those carriers operate independent messaging programs.

Consent is not a condition of purchase. You are not required to consent to receive autodialed or prerecorded calls or text messages as a condition of purchasing any goods or services from TFD Insurance or any partner.
This section is a TCPA-compliant express written consent disclosure. By clicking a button labeled "Get My Quote," "Submit," "See My Rates," or any similar call-to-action on the TFD Insurance website while your phone number is present in the form (or by providing your phone number to a TFD Insurance representative), you provide express written consent under the federal Telephone Consumer Protection Act (TCPA) and any analogous state law for TFD Insurance and the insurance carriers, brokers, and licensed agents in our partner network to contact you at the wireless or landline phone number(s) you provided. The methods of contact you authorize include live operator calls, automatic telephone dialing system (autodialer) calls, artificial or prerecorded voice messages, ringless voicemail, SMS text messages, and MMS multimedia messages. The purposes for which you authorize contact include sales, marketing, telemarketing, insurance solicitation, quote follow-up, application assistance, and customer service.
You acknowledge and agree that this consent applies whether or not your number is registered on a federal, state, or internal Do Not Call list. You acknowledge that consent is not required as a condition of purchasing any goods or services and that you may instead contact a licensed agent at (888) 555-0142 to request quotes by phone. You may revoke this consent at any time using any reasonable method, including by replying STOP to a text message, by emailing [email protected], or by calling us at (888) 555-0142. Revoking consent does not retroactively affect communications sent before TFD Insurance received the revocation.
You represent and warrant that you are the subscriber of, or are otherwise authorized to give consent for, the phone number you provided.
All content on the Services, including text, graphics, logos, icons, images, software, and the underlying compilation, is the property of TFD Insurance or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. Any other use, including reproduction, modification, distribution, framing, scraping, or republication, is prohibited without our prior written consent. The TFD Insurance name and logo are trademarks of TFD Insurance.
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, TFD Insurance disclaims all warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy.
Information presented through the Services is provided for informational purposes only and should not be construed as insurance, financial, legal, or tax advice. Quote estimates, rate ranges, and savings figures are illustrative and not a guarantee of actual coverage availability, pricing, or terms, all of which are determined solely by third-party carriers based on their own underwriting. TFD Insurance does not guarantee that any particular carrier will offer you a policy or that any policy will meet your specific needs.
To the fullest extent permitted by law, TFD Insurance and its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, business opportunities, goodwill, or other intangible losses arising out of or relating to your use of, or inability to use, the Services, even if we have been advised of the possibility of such damages. We are not liable for the acts, omissions, advice, products, or decisions of any third-party carrier, broker, or licensed agent, including underwriting decisions, claims handling, premium calculations, cancellations, or policy terms. In no event shall our aggregate liability for all claims related to the Services exceed one hundred U.S. dollars (USD $100). Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.
You agree to indemnify, defend, and hold harmless TFD Insurance and its officers, directors, employees, agents, contractors, and affiliates from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use or misuse of the Services, (b) your violation of these Terms, (c) information you submit through the Services that is false, misleading, or unauthorized, (d) your violation of any law or the rights of any third party, including the TCPA or analogous state law, and (e) any dispute between you and a third-party carrier, broker, or agent.
The Services may contain links to, or be embedded with content from, third-party websites and services, including insurance carriers and analytics providers. TFD Insurance does not control these third parties and is not responsible for their content, terms, privacy practices, or products. Your interactions with any third party are solely between you and that third party.
We may modify these Terms at any time. When we do, we will post the revised Terms on this page and update the "Last Updated" date. Material changes will be effective when posted unless otherwise noted. We encourage you to review the Terms periodically. Your continued use of the Services after a change becomes effective constitutes your acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using the Services.
These Terms and any dispute arising out of or relating to the Services are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Subject to Section 14, the state and federal courts sitting in Wilmington, Delaware shall have exclusive jurisdiction over any dispute not subject to mandatory arbitration, and you consent to personal jurisdiction in those courts.
Informal resolution first. Before filing a formal claim, you agree to first contact TFD Insurance at [email protected] and describe the dispute in writing so we have a chance to resolve it informally. If the dispute is not resolved within thirty (30) days, either party may proceed to arbitration as described below.
Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that is not resolved informally shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in the English language and, unless the parties agree otherwise, in Wilmington, Delaware (or by telephone or video conference where permitted by the AAA rules). Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.
Class action waiver. You and TFD Insurance each agree that any dispute will be resolved on an individual basis only. You and TFD Insurance waive any right to participate in a class, collective, consolidated, or representative action. The arbitrator may not consolidate claims and may not preside over any form of class proceeding. If a court finds the class action waiver unenforceable, the entire arbitration provision shall be null and void, but the remainder of these Terms shall survive.
Opt-out. You may opt out of arbitration by sending a written notice to [email protected] within thirty (30) days of first accepting these Terms, stating clearly that you wish to opt out of arbitration.
